Welcome to the mmlj-llc.com website, which operates under the tradename MMLJ (the "Site").

Except as otherwise noted, these Terms and Conditions (the "Terms") govern your use of the Site. Please read them carefully, since your visit to the Site - and the activities you partake in herein, including placing an order, serve as your agreement to be bound by them. Your use of the Site is subject to your compliance with these Terms. If you do not agree to abide by them, you should not access or use the Site, or place any order.

MMLJ reserves the sole right to change the Site and Terms at any time. Any changes will be posted here, so to keep updated, please review the Terms every time the Site is accessed.

Additionally, by accessing and using the Site, you agree to be bound by the terms found in our Privacy Policy. Any personal information you supply to us when using the Site will be used by us in accordance with our Privacy Policy.

Electronic Communications

When you visit the Site or send emails to MMLJ, you are communicating with MMLJ electronically. By doing so, you consent to receive communications from MMLJ electronically. MMLJ will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures, and other communications provided in this electronic manner satisfy any legal requirement that such communications be in writing. MMLJ will send related information, promotions, and special discounts to the email address provided by its customers unless a customer indicates he/she no longer wants to receive these email communications (opt-out) by sending an email to customerservice@mmlj-llc.com

All the content seen on the Site, including, but not limited to, page headers, images, illustrations, graphics, audio clips, video clips and text (collectively known as "Content") is the exclusive property of MMLJ and/or is subject to trademark, service mark, trade dress, copyright and/or other intellectual property rights or licenses held by MMLJ, by any affiliate or third party that has licensed or assigned their rights, interests, and/or material to MMLJ.

The Content is copyrighted as collective work under U.S. and other applicable copyright laws, and MMLJ owns a copyright in the selection, coordination, arrangement, and enhancement of the Content. Both the Content and the Site are intended solely for the personal and non-commercial use of the users of the MMLJ site.

You may download, print, and store selected portions of the Content, but only if (1) you use any such copies of the Content only for your own personal and non-commercial use, (2) you do not copy or post Content on any network computer or broadcast the Content in any media and/or in any form or format, (3) you do not modify or alter the Content in any way, or delete or change any copyright or trademark notice, and (4) you properly credit all intellectual property rights. No right, title, or interest in any downloaded or copied materials are transferred to you as a result of copying, downloading, or other activity. MMLJ reserves complete title and full intellectual property right in all Content. Except as noted above, you may not copy, download, reproduce, modify, publish, distribute, transmit, transfer, or create derivative works from the Content without first obtaining the express written permission of MMLJ.

Membership Account

If available, and you use the Site to create an account, you are responsible for maintaining its confidentiality and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use the website only with involvement of a parent or guardian. MMLJ and its associates reserve the right to refuse service, remove or edit content, or cancel orders at their sole discretion.

Reviews, Comments, E-mails, and Other Contents

If allowable, you may post reviews, comments, and other content and submit suggestions, ideas, comments, questions or other information, as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of a submission or other content. MMLJ reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

If you post content or submit material, you grant MMLJ and its associates a nonexclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, and display such content throughout the world in any media format. You also grant MMLJ and its associates the right to use the name you submit in connection with such content, if MMLJ chooses to do so. You represent and warrant that you own or otherwise control all the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify MMLJ or its associates for all claims resulting from content you supply. MMLJ has the right but not the obligation to monitor, edit, or remove any activity or content. MMLJ takes no responsibility and assumes no liability for any content posted by you or any third party.

Indemnification

You agree to defend, indemnify, and hold MMLJ harmless from and against any and all claims, damages, costs, and expenses, including attorney's fees, arising from, or related to your use of the Site. You agree to indemnify MMLJ from all claims of third parties including intellectual properly right claims related to a name, logo, brand, design, or any other form of intellectual property you provide to MMLJ.

ALL CONTENT, PRODUCTS, AND SERVICES ON THE SITE ARE PROVIDED TO YOU “AS IS” WITHOUT WARRANTY OF ANY KIND EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY OR ACCURACY. MMLJ DOES NOT WARRANT THAT THIS SITE, ITS SERVERS, OR E-MAIL SENT FROM THIS SITE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. MMLJ IS NOT LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. Terms Governing Purchase and Delivery of Product

General: For the purposes of this section only, "you" refers to a customer who purchases products from MMLJ. When you purchase a product(s) from MMLJ, you agree to pay the agreed-upon price. This price, including delivery fees and taxes, if any, is to be paid in full at the time your order is placed (see "Additional Information" for Custom Products). MMLJ reserves the right to cancel the order and reimburse possible payments, if the goods ordered are not available. In this case, MMLJ will inform you immediately of the unavailability of the goods. Any products purchased from the Site are for personal use only. You agree not to reproduce, duplicate, copy, sell or resell any of the products purchased from the Site.

Additional Information: If you order from our "Custom Product" selections, MMLJ requires a 60% deposit at the time of purchase. When the Custom Product is completed, MMLJ requires the remaining 40% balance prior to shipping.

Address and Order Changes: In cases when the order or address information needs to be changed after an order is placed, MMLJ will make a reasonable effort to adjust the order or address; nevertheless, if costs have already been incurred, you will have to either accept the original order details at the original price or pay additional charges to remake and/or ship the goods.

Delivery Time: MMLJ will make our best effort to create and deliver the products ordered (non-custom products) within 7 - 10 business days; however, delivery time is not guaranteed. Delivery times for Custom Products will vary based on a customer approved order. MMLJ is not liable and will not pay for claims for any direct or consequential loss caused by delivery times or delays after the order date. All products are shipped either via United States Postal Service (USPS) or United Parcel Service (UPS) with tracking numbers. Note: Due to the COVID-19 pandemic, there may be unavoidable shipping delays associated with carrier services (USPS and UPS).

Quality Issues: It is your responsibility to notify MMLJ (of any issue with your product within 7 days after delivery, and if applicable, send MMLJ corresponding photo(s). MMLJ will work with you to meet your expectations regarding the quality of your product(s). If we are not able to meet these quality expectations, we may offer a refund. See next section for MMLJ's return policy.

Money Back Guarantee: Unless the customer has approved the proof/sample design of a Custom Product, MMLJ will offer a refund upon request by the customer for non-custom products if and after the following conditions are met: (i) You report the issue and/or make a money back request within 7 days after delivery of the product and (ii) You return the product(s) back to MMLJ, paying for all return shipping charges. MMLJ will refund the applicable amount within 7 days after receiving the returned product(s). If MMLJ furnished you with a proof/sample design of a Custom Product, and you approved the proof/sample design, this Money Back Guarantee does not apply to your order and no refunds will be available.

Severability

If any of the provisions of these Terms shall be unenforceable, the applicable legal authority (such as an arbitrator or judge) shall have the right to amend said provision and the Terms overall to allow the spirit of it to be enforced. Even if there are provisions which remain unenforceable, these Terms shall be otherwise enforced in full.

Disputes

If a dispute between the parties exists which arises from or is related to these Terms & Conditions, Privacy Policy, the products, the services, or the Site, the Parties irrevocably agree the mandatory provisions below in this section apply.

The parties first must and shall engage in informal good faith resolution efforts. Only after such good faith efforts are made, but fail, can any formal dispute resolution process can be initiated.
The formal dispute resolution process shall and must be binding arbitration to take place in York County, South Carolina. Should a lawsuit be filed instead of arbitration initiated, the parties agree that the applicable court should either dismiss said suit or stay it so that this mandatory arbitration process can take place and be completed.
Unless the parties agree otherwise in writing, including anything in these Terms, the arbitration shall be through the American Arbitration Association and shall be subject to that body’s Consumer Arbitration Rules in effect at the time of the arbitration’s initiation, as those rules are published on the American Arbitration Association’s website (currently www.adr.org).
Each party shall be responsible for its own costs and legal fees, including attorneys’ fees, except that a party which wrongfully disregards the mandatory arbitration process described herein and instead initiates formal litigation may be required to pay the other party’s costs and legal fees, including attorneys’ fees.
Regardless of any other language in these Terms, unless equivalent relief can be obtained from an arbitrator in a timely fashion, MMLJ may seek an equitable remedy such as, but not limited to, a restraining order from a court if reasonably necessary to do so on an urgent basis to prevent immediate and serious harm to MMLJ.

Applicable Law and Venue

Shipments to USA, Canada, or Mexico: You are doing business with MMLJ (Business Address: 2764 Pleasant Road Suite A PMB 610, Fort Mill, SC 29708-7214, United States of America). By visiting this Site, you agree that the laws of the state of South Carolina in the United States of America, without regard to principles of conflict of laws, will govern the Terms and any dispute of any sort that might arise between you and MMLJ or its associates. Any dispute relating in any way to your visit to this Site or to products you purchase through the Site shall be submitted to a court or arbitration, as applicable, in the state of South Carolina, in the County of York.
